Legal Services Unit
Objective
To
provide professional legal advice on HR compliance, appeals and complaints to
the Commission.
The Unit
perform the following activities:-
- Provide assistance to
Departments, Sections and Units on interpretation of laws, terms of contract,
terms of agreements, privatisation agreements, procurement contracts,
guarantees, letters of undertaking, memorandum of undertaking, consultancy
agreements and other type of agreements and other legal documents;
- Provide legal services in sessions for disposal of appeals by assisting
the commission in preparation of decision in respect of appeals and complaints
and communication of the same to the parties;
- Render legal guidance in management meetings and conduct awareness
including sensitization on matters of law and dispensation of justice to staff
of the Commission and stakeholders;
- To identify and recommend for areas in the Public Service Act (s) which need
to be reviewed or repealed and ensure harmonization of other related
legislations;
- Coordinate programmes for capacity building to commissioners on legal
matters and dispensation of justice;
- Cooperate and liaise with Chief Parliamentary Draftsman and Attorney
General’s Chamber in preparation of Bills/Acts, subsidiary legislations of the Government in judicial
contests;
- Make follow up and monitoring
of cases in Courts of law/tribunals and maintain data base on commissions and
courts decisions in respect of appeals
and complaints;
- Provide clarification on issued guidelines, circulars, regulations,
memorandum of understanding, and other legal documents; referred to it from the
Commission Departments, Sections and Units;
- Endeavor with Governments Public Service Institutions in ensuring
compliance with public service legislations and required standard for effective
mechanism adherence;
- Ensuring legitimate, motivated
efficient transparent and continuous
decision making process of the Commission by offering proper professional legal
advice;
- Oversees performance of the Disciplinary Authorities role and decisions
in different areas within the country and rectify where necessary for effective
implementation of public service legislations.
